These Keys of Swan Service Agreement terms (the "Agreement") govern your enrolment in and receipt of mobile piano teaching services (the "Service"). This Agreement also incorporates our Privacy Notice, which is located at www.keysofswan.com/privacy.
1.2
The Service is provided by Keys of Swan ("Keys of Swan", "we", "us", "our"). The term "you" refers to the student and/or parent/guardian enrolling in piano lessons.
1.3
Please read this Agreement carefully. It contains important information regarding your legal rights, including limitations on liability, cancellation policies, and payment terms. By enrolling in lessons with Keys of Swan, you irrevocably agree to comply with this Agreement. You may not use the Service if you do not agree to these terms.
2.1
Piano lessons are available to students of all ages. For students under 18 years of age, enrolment must be completed by a parent or legal guardian who agrees to these terms on behalf of the student.
2.2
When you enrol in lessons, you represent and warrant that all information you provide is accurate, up-to-date, truthful and complete. You agree to keep your contact information current at all times.
2.3
Keys of Swan may refuse service or terminate lessons if we determine that enrolment information is inaccurate or if these terms are violated.

Lesson Options

Travel Surcharge
A travel surcharge of $10 per lesson applies for locations outside our designated free travel zone. If travel time is 45 minutes or more from the CBD, higher fees may apply. All applicable charges will be confirmed during enrolment.

Supervision Requirements
For students under 18 years of age, a parent or legal guardian must be present on the premises at the beginning and end of each lesson. If the parent/guardian must leave momentarily during the lesson, they must inform the teacher before doing so.

Payment Schedule
Payment for lessons must be received at least 24 hours in advance of the scheduled lesson via bank transfer.

Outstanding Balances
All outstanding balances must be settled before lessons can resume following suspension for non-payment.

Teacher Cancellations
In the event your teacher needs to cancel, you will receive as much notice as possible. A make-up lesson will be scheduled at a mutually convenient time. If a make-up lesson cannot be scheduled, you will receive a credit or refund.
5.3
Severe Weather or Emergency
In cases of severe weather, natural disasters, or emergencies that make travel unsafe, lessons will be rescheduled. You will be notified as soon as possible of any changes.
6.1
Permanent Schedule Changes
Requests to permanently change your lesson day or time require at least 1 week's notice. We will make reasonable efforts to accommodate your request, subject to teacher availability.

Discontinuation of Service
If you wish to discontinue lessons, you must provide 1 week's written notice. Payment is required for all scheduled lessons within the notice period.

Students are encouraged to practice regularly between lessons to optimise learning and progress. Your teacher will provide specific practice guidance tailored to your level and goals.

Insurance Coverage
Keys of Swan carries public liability insurance for mobile teaching services.
9.2
Limitation of Liability - Instruments and Property
While every care is taken during lessons, Keys of Swan and our teachers are not responsible for damage to your instrument during normal lesson activities. We are not liable for loss or damage to personal property in your home. You are responsible for ensuring the safety of the learning environment and maintaining appropriate insurance coverage for your property.

Student Safety and Supervision
Parents and guardians are responsible for student supervision before and after the scheduled lesson time. Your teacher's duty of care is limited to the scheduled lesson duration only.
10.1
Our teachers maintain professional boundaries at all times. Our teachers will not enter homes where there is evidence of unsafe conditions. We reserve the right to reschedule or discontinue lessons if professional boundaries are not respected or if the learning environment is deemed unsuitable or unsafe.

Privacy
Student information is kept confidential and will not be shared with third parties except as required by law. Please refer to our Privacy Notice at www.keysofswan.com/privacy for complete details on how we collect, use, and protect personal information.

Photos and Videos
We may occasionally take photos or videos for educational purposes, progress tracking, or promotional materials. Written consent will be obtained before any images are used publicly. You may withdraw consent at any time by providing written notice.

Keys of Swan reserves the right to discontinue the Service with a student if:

We may update this Agreement from time to time to reflect changes in our practices or for legal or regulatory reasons. Updated versions will be dated and current students will be notified of significant changes. Continued use of the Service after changes constitutes acceptance of the updated Agreement.

By enrolling in lessons with Keys of Swan, you acknowledge that you have read, understood, and agree to be bound by this Agreement. A signed enrolment form incorporating these terms will be provided to you and must be completed before lessons commence.
